Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Sunny Javed trading as Software Link ("we", "us", "our"), a sole trader based in the United Kingdom, covering your use of Kumo ("Kumo", the "Service"). By signing up for, paying for, or using Kumo, you agree to these Terms. If you don't agree, don't use the Service.

Please also read our Privacy Policy and Disclaimer, which form part of these Terms.

1. Eligibility & age

You must be at least 16 years old and able to enter a binding contract to use Kumo. By using Kumo you confirm that you are.

2. Your account

Your Kumo account is tied to the phone number you sign up with. You're responsible for activity that happens through your number. Tell us promptly if you think someone else is using your account.

3. What Kumo is (and isn't)

Kumo is an AI-powered accountability companion that sends you text messages — scheduled check-ins, reminders, and replies — to help you stay on track with goals you choose. Kumo is an automated AI service, not a human, and not a coach, therapist, doctor, dietitian, financial adviser, or other professional. See the Disclaimer for important limitations. Kumo cannot see your screen or detect in real time what you're doing; it works from the schedule and information you give it.

You must give us accurate information and use Kumo for your own personal accountability only.

4. Messaging consent

By signing up, you consent to receive automated text messages from Kumo, including proactive check-ins, reminders, and follow-ups, at the times and frequency you set up or that are reasonably necessary to provide the Service. Message and data rates may apply depending on your carrier. You can opt out at any time by replying STOP, after which we'll stop sending you messages (this may end the Service).

5. Acceptable use

You agree not to:

  • use Kumo for anything unlawful, harmful, harassing, or abusive;

  • use it on behalf of anyone else, or to message or target other people;

  • attempt to reverse-engineer, scrape, overload, or disrupt the Service;

  • misrepresent your identity or age; or

  • use Kumo to generate or store content that is illegal or infringes others' rights.

We may suspend or terminate your access if you breach these Terms.

6. Subscriptions, billing, trials & auto-renewal

Plans & prices. Kumo is a paid subscription. Current pricing is £9.99/month, or £39.99/year (plus any applicable taxes). We may change prices for future billing periods and will give you reasonable notice.

Free trial. We may offer a free trial currently 3 days, on the yearly plan. To start a trial you provide a payment method. If you do not cancel before the trial ends, your subscription automatically starts and your payment method is charged the applicable price.

Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or yearly) and your payment method is charged, until you cancel. By subscribing you authorise these recurring charges.

Payment. Payments are processed by Stripe. We don't store your full card details. You're responsible for keeping a valid payment method on file.

7. Cancellation & refunds

Cancel anytime. You can cancel your subscription or trial at any time via the billing/management link we provide (or by asking us). Cancellation stops future charges and takes effect at the end of your current paid period; you keep access until then.

Refunds. Refunds. First-time subscribers may request a refund within 14 days of their first paid charge by contacting us at support@softwarelink.co.uk. Renewal payments are generally non-refundable unless required by law, but we may review refund requests case by case. To avoid future charges, cancel before your next renewal date.

Your statutory rights (UK). If you're a consumer in the UK, you normally have a 14-day right to cancel a distance contract for a refund. However, because Kumo is digital content/services supplied immediately, by starting the Service (or your trial converting to paid) you agree to us beginning supply straight away and acknowledge you may lose this 14-day cancellation right to the extent the Service has been provided. Nothing in these Terms removes rights you have under the Consumer Rights Act 2015 or other mandatory consumer law.

8. Intellectual property

We (and our licensors) own Kumo, its software, branding, and content. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Kumo for its intended purpose. You keep ownership of the content you send; you grant us a licence to store and process it to operate the Service (see the Privacy Policy).

9. Disclaimers

Kumo is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, always delivered on time (message delivery depends on carriers and third parties), or that it will produce any particular result. Kumo does not give professional advice — see the Disclaimer.

10. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, and to the fullest extent permitted by law:

  • we are not liable for indirect, incidental, or consequential losses, lost profits, lost data, or missed goals/outcomes; and

  • our total liability to you for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.

11. Termination

You can stop using Kumo and cancel at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we stop offering the Service. Sections that by their nature should survive (e.g. IP, disclaimers, liability) survive termination.

12. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version and change the "Last updated" date; material changes may be notified to you. Continuing to use Kumo after changes take effect means you accept them.

13. Governing law & disputes

These Terms are governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
